The Hearing Process
After you receive your official notice that your license has been suspended under ALR, you have 15 days to request a hearing. Hearings can be performed either in person or by phone, and your case will be handled by an Administrative Law Judge, or ALJ. Depending on the reason for your license suspension, the ALJ will look at questions such as:
- Did the officer stop you for a valid reason?
- Was there reason to believe that you were inebriated?
- Did you have the option to take a sobriety test?
The ALJ listens to the cases presented by both DPS and the person whose license is in question, and then he or she makes an official decision whether or not to uphold the suspension.
