  • Criminal cases deal with instances in which a person has breached a law, while civil cases deal with instances of negligence or breach of civil duty.
  • In civil cases, defendants can either defend themselves or pay for their own defense lawyers. In criminal cases, if the defendant cannot afford an attorney, the state provides one.
