“No Refusal” Days
Each state has its own regulations on administering blood tests, some only allowing breathalyzer tests, and others giving law enforcement a choice. In Texas, more and more cities are adopting what is called a “no refusal” policy for their citizens, hoping to cut down on the number of DWI incidents. “No refusal” means that people who are suspected of DWI will be asked to take a breathalyzer test and if they refuse, law enforcement will obtain a warrant for a mandatory blood test immediately. Most often, “no refusal” days occur on holidays like Memorial Day, July Fourth, and Labor Day Weekend.
