BAC Levels

In Texas, any driver over the age of 21 with a BAC of .8 or higher is legally under the influence and will be prosecuted for violating the DUI law. For those under 21 there is a zero tolerance policy, meaning minor drivers with any alcohol in their system will be prosecuted for DUI.
