What Is a No-Refusal Weekend?
In Texas, many police departments are using what is known as a no-refusal weekend to increase their ability to catch individuals they believe to be driving under the influence. These weekends usually occur on and around major holidays, and the process of fighting a DWI charge made on a no-refusal weekend can be very different from fighting standard DWI charges.
If you have been charged with DWI or another alcohol-related driving offense, we may be able to help you fight these charges. What Happens on No-Refusal Weekends?
When the police declare a no-refusal weekend, they are ultimately announcing that drivers will not have the option to refuse being tested for intoxication if they are stopped. Normally, a person can refuse testing when pulled over on suspicion of DWI. When this happens, and the individual in question is arrested, the police have to wait for a warrant before they can legally require alcohol or drug tests.
On no-refusal weekends, however, this changes in the following ways:
- Police conduct all arrests and alcohol testing in the same location
- After an arrest, a person is immediately served a warrant for testing
- After the warrant is served, the person is immediately tested for alcohol and / or drugs
Because the police do these procedures all in one location and within a tight schedule, any time lost between being arrested, receiving the warrant, and traveling to a hospital for alcohol testing is cut out of the process.
