Woman arrested for DWI on birthday

A woman was arrested in Weatherford, Texas for driving while intoxicated. She was pulled over and submitted to a sobriety test which she ultimately failed.

The woman in question is the daughter of Sam Walton, the Wal-Mart founder, and is worth $20.9 billion. She refused to take a blood-alcohol test and was taken into custody on the night of her 62nd birthday and held overnight.

The next morning she was released on $1,000 bail.

This is the third time that Walton has been charged for driving while intoxicated.

Houston Drunk Driver Charged in Fatal Crash

An alleged Houston drunk driver has been charged in a fatal traffic accident last weekend.

According to court docuemtns, 22 year-old Nefi Cruz is charged with accident involving injury and intoxication manslaughter in the 176th State District Court. Several witnesses said the victim of the accident, Rodrigo Caballero Cisneros, was driving a black Ford Mustang east on Harwin Road shortly after 2:05 a.m. Cruz was traveling southbound on the West Sam Houston Parkway in a silver Volkswagen Golf.

Witnesses report that Cruz ran a red light at the intersection of HArwin Road and the Volkswagen struck the ford, causing it to spin and hit the concrete median on the south side of the roadway. Response crews pronounced 30 year-old Cineros dead at the scene.

According to officials with the Houston Police Department, Cruz fled the scene on foot and was apprehended by officers a short distance away.

Houston Man Charged with DWI, Intoxication Assault

A Houston man was charged with driving while intoxicated after a car accident Wednesday.

According to officials with the Houston Police Department, 41 year-old Eduardo Palacios was charged with driving while intoxicated and intoxication assault after a car accident in Harris County Wednesday. Police say Palacios collided with the back of Deputy Leigh Nicely’s patrol car as she was stopped writing a ticket on the Katy Freeway shortly after 10:00 a.m. Wednesday.

According to the accident report, Nicely was transported by ambulance to an area hospital for treatment of back and knee injuries. No information on the extent of her injuries was available.

Palacios is being held in Harris County Jail without bond. He is scheduled to appear in court Friday.

More Information on Houston Cop Charged with DWI

The trial of a Houston Police officer charged with driving while intoxicated began Tuesday morning.

Officer Ruben Trejo of the Houston Police Department was charged with DWI after a crash with a school bus in Houston last week. Police originally cited the school bus driver in the accident, but witnesses claimed Trejo ran a stop sign, causing the crash. The bus driver told police Trejo smelled of alcohol after the crash. A bottle of
wine was found in his squad car.

According to court documents, investigators claimed Tuesday morning that Trejo’s blood alcohol content was .176 at the time of the accident, more than twice the legal limit in Houston.

Trejo’s attorney, Paul Nugent, said he did not believe his client received special treatment from the police department. “We feel Sergeant Trejo was treated fairly and he was not on-duty at the time of the accident,” Nugent said.

Internal Affairs is now investigating the crash. Trejo has been relieved of duty pending the outcome of the investigation.

Houston Police Officer Charged with DWI After Crash with School Bus

A police officer in Houston who was injured in a crash with a school bus this month has been charged with DWI.

According to officials with the Houston Police Department, 46 year-old Sergeant Ruben Trejo was on his way to work on April 13 when he collided with a school bus in the 7900 block of Harrisburg shortly afer 2:15 p.m. in East Houston. At the time of the accident, a department spokesman said the bus driver ran a stop sign and caused the accident, but witnesses reported seeing the officer run a stop sign.

The bus driver told reporters she thought the Trejo had been drinking. “He smelled drunk and he had beer and wine opened in his car,” Teresa Argueta said.

Trejo was relieved of pay on Friday after an investigation led to DWI charges.

Two Charged with DWI in Houston

Two people were arrested on charges of DWI in Houston Friday.

According to officials with the Houston Police Department, the first arrest occurred shortly after 3:00 p.m. Friday on the northwest side of the city. Authorities say 49 year-old Licking-resident Frank W. Davey was arrested on charges of DWI – chronic offender. Davey was also charged with driving while revoked. He was transported to the county jail.

The second arrest took place at approximately 5:00 p.m. in downtown Houston. According to the arrest report, 58 year-old Houston-resident Carol Y. Brim was charged with DWI – first offense. She was also charged with careless and imprudent driving resulting in an accident. She was released to another party. The details of the accident have not been made public.

DWI Conviction for Houston Man

A Houston man was convicted of drunk driving Wednesday, despite claims that his daughter was driving his vehicle.

According to Assistant District Attorney Andrew Herreth, 63 year-old Gregorio Rubalcaba Cano was charged with DWI after a resident called police to report his erratic driving in December 2005. Jalene Blanscet was traveling north on U.S. 59 when a Cano’s white Chevy Astro van drove into her lane and ran her off the road, Herreth said. Blanscet kept control of her vehicle and followed the van, calling 911 and relaying the vehicle’s information to the dispatcher.

Police officer Joyce Combest stopped the van and, having received information that the passenger had been driving, approached the passenger’s door first. The officer noticed that Cano was incoherent with glassy eyes. Cano insisted that he had not been driving the vehicle at the time of the accident.

At the trial, Cano and his daughter Hilary testified that she was behind the wheel when the van passed Blanscet. The jury, however, found Cano guilty of Driving While Intoxicated.

Southern Dallas County Fire Chief Charged with Felony DWI

A Southern Dallas County fire chief was charged with DWI Wednesday.

According to Dallas County Prosecuting Attorney Barbara J. Viets, 34 year-old David Rowland, chief of the Southern Dallas County Fire District, was charged with Class D felony driving while intoxicated. Following the charge, Rowland was relieved of his duties as fire chief.

According to the criminal complaint, Rowland was arrested shortly after 3:00 p.m. March 10 at an O’Reilly Automotive on Ash Street. Officer Justin Weathers of the Buffalo Police Department said that Rowland was involved in an accident at the auto-parts store. Weathers noticed Rowland had watery, glassy eyes and was leaning against his vehicle after the crash, the report says.

Rowland failed a field sobriety test and was administered a breath test which showed his blood alcohol content to be .158 percent.

House Committee Urged to Repeal Texas DWI Surcharge Program

A House committee was urged by lawmakers Tuesday to repeal the Texas Driver Responsibility Program.

The goal of the Texas Driver Responsibilty Program was to stick people convicted of drunken driving with large surcharges, on top of regular fines and punishment. The revenue from the three-year-long surcharges was supposed to go to hospital trauma centers and highway projects.

Critics of the program told a House committee on Tuesday that it has failed to live up to the original goals of the Legislature. “This is a classic example of legislation that had incredible unintended consequences,” said Rep. Lon Burnam, D-Fort Worth. “IT was an ill-conceived law and an example of bad tax policy.”

Opponents of the program cited a recent report from the Senate Criminal Justice Committee that found the program had actually decreased DWI conviction rates and increased dismissal rates since it was implemented in 2003. Thousands of drunken driving defendants have asked for a trial, in order to avoid the DWI surcharges, forcing prosecutors to accept plea bargains for lesser offenses such as reckless driving.

Harris County ‘No Refusal’ Program Expanded for St. Patrick’s Day

The Harris County District Attorney’s “No Refusal” anti-DWI program will expand operations this week for St. Patrick’s Day.

According to District Attorney Patricia Lykos, county-wide operations will expand to help protect the higher volumes of travelers expected for a trio of area festivities, including the Houston Livestock Show and Rodeo, St. Patrick’s Day, and spring break. The “No Refusal” program will extend beyond the normal weekend deployments in conjunction with area law enforcement agencies that will be increasing DWI enforcement patrols.

Chief of the District Attorney’s Vehicular Crimes Section, Catherine Evans, said the expansion of the anti-DWI program coincides with the series of events which have been linked to drinking and driving. “Our advice is always to enjoy these special festivities and celebrations,” Evans said. “Just be sensible and make smart choices.”
