How to Save Your License
A common consequence of being convicted of DWI is a suspension or revocation of your driver’s license. In addition, if you refuse to submit to a Breathalyzer when you are arrested, your license may be suspended until your trial. Fortunately, there are steps you can take to help prevent the suspension or loss of your driver’s license.
One of the first steps you should take is to contact an experienced attorney who can help you protect your legal rights. For important legal information and support, call the Houston DWI defense lawyers of Johnson, Johnson & Baer, P.C., at 713-222-0400.
Your License Revocation Hearing
In Texas, license suspension and revocations are overseen by the Texas Administrative License Revocation Program, or ALR. If you are arrested for drunk driving, you will likely need to appear at two hearings: your DWI trial, and your administrative license revocation hearing. You must request an ALR hearing within 14 days of your arrest or your license will be automatically suspended.
At the hearing, a representative from the Department of Public Safety will need to present the evidence against you. He or she will need evidence that: your arresting officer had just cause to pull you over; you showed signs of intoxication after being pulled over; you were offered a chance to take a blood alcohol content test; and you refused the test.
If any of this evidence is missing, the DPS may not have grounds to suspend or revoke your driver’s license.
Occupational Driver’s Licenses
Even if your license is suspended or revoked, you may be eligible to receive an occupational driver’s license (ODL). An ODL allows you to use your motor vehicle to drive to work, school, and important household errands. Many people who are arrested for or convicted of drunk driving are eligible to receive an ODL.
Ignition Interlock Devices
If you are allowed to keep your driver’s license or obtain an ODL, you may need to agree to the installation of an ignition interlock device in your vehicle. This is a device that contains a Breathalyzer test. You must take the test in order to start your motor vehicle; if your blood alcohol level is above a set limit (usually .02 or .04), your vehicle’s engine will not start.
Unfortunately, these devices can be expensive. The initial installation fee can be up to $200, and you may need to pay a monthly rental fee. However, these costs may be worth it if you need your car to complete important daily tasks.
